Terms of service

1. Our services and your contract

Service descriptions on this site are summaries. What we deliver is set out in your order, quote, statement of work or contract. If any of those differ from these terms, the signed document applies.

2. Your account

• You sign in with a SocialWorks account. Keep your email and phone up to date and don't share your codes.
• You are responsible for what happens under your account; tell us at once if you suspect misuse.
• We may suspend access to protect you, us or others, and will tell you why unless the law prevents it.

3. Quotes, orders and prices

• Prices are in Indian rupees. GST is added at the applicable rate and shown before you pay.
• A quote is valid until the date on it. An order is accepted when we confirm it or receive payment.
• We may correct an obvious pricing error before accepting an order; if we do, you may cancel for a full refund.
• We issue a GST invoice for every payment. Give your GSTIN at checkout if you want to claim input tax credit.

4. Payment

Payments are processed by our payment partner, Razorpay, using the methods shown at checkout (such as UPI, cards and net banking). Its terms also apply to the payment. Invoices under a contract are due as the contract states; we may pause services on overdue accounts after notice.

5. Cancellations and refunds

6. Your responsibilities

• Give us accurate information and the access, approvals and site conditions our work needs.
• Keep your own backups unless backup is part of the service you bought from us.
• Hold the right licences for software you ask us to install or manage.
• Don't use our site, workspace or services to break the law, harm others, send spam, attack systems, or interfere with them.

7. Third-party products

Hardware, software and cloud services from other companies are covered by their makers' warranties and terms, which we pass on to you. We help you with warranty claims but can't extend a maker's warranty. Product names on this site are trademarks of their owners and don't imply any affiliation.

8. Intellectual property

The content and design of this site belong to ServerWorks. Work we create for you passes to you as your contract states; our own tools, know-how and products (including SocialWorks) remain ours, with the licence your contract gives you.

9. Your data

Your data stays yours. We use it only to provide the services and as the privacy policy explains, and keep it confidential.

10. Limitation of liability

To the extent the law allows: we are not liable for indirect or consequential loss, such as lost profits, lost data or business interruption; and our total liability for any claim is limited to the amount you paid us for the service concerned in the twelve months before the claim. Nothing here limits liability that the law doesn't allow to be limited.

11. Events beyond control

Neither of us is responsible for delays caused by events beyond reasonable control, such as natural disasters, power or network failures of third parties, strikes, or government action.

12. Governing law and disputes

These terms are governed by the laws of India. We will first try to settle any dispute through our grievance process. Courts at [city] have exclusive jurisdiction, without affecting your rights as a consumer under the Consumer Protection Act, 2019.

13. Changes

We may update these terms and will post the new version here with its date. Orders already placed follow the terms that applied when you placed them.
